Welcome to The Original Rainbow Cone Century of Smiles Contest (the “Contest”) where each eligible entry provides a chance to win a year’s worth of free Rainbow Cones.

Beginning in the month of January 2025, Rainbow Cone LLC (“Rainbow Cone”) will run a monthly contest from which one (1) eligible entry will be selected as the winner. An eligible entry shall consist of a social media (Instagram, TikTok or Facebook only) (“Designated Social Media Platforms”) post made by an eligible contestant which: (a) includes a photograph (not drawing or illustration) or video of the contestant enjoying The Original Rainbow Cone; (b) includes the hashtag #CenturyOfSmiles; (c) tags in the post @TheOriginalRainbowCone; and (d) tags at least five (5) non-sponsored, valid accounts on the same Designated Social Media Platform. Each eligible participant can obtain up to a maximum of five (5) entries in the contest by posting a different photograph or video of the contestant enjoying The Original Rainbow Cone, including the same hashtags/tag and tagging an additional five (5) non-sponsored, valid accounts on the same Designated Social Media Platform. The winning eligible entry will be the one that attracts the most “likes” from non-sponsored, valid accounts across all Designated Social Media Platforms. To be eligible, the entry(ies) must also include all of the components stated herein.

1. Eligibility: The Original Rainbow Cone Century of Smiles Contest (“Contest”) is open to legal residents of any US state who are 13 years of age or older at the time of entry. Minors under the age of 18 must obtain permission from their parent or legal guardian to enter. Employees of The Original Rainbow Cone, Buona Beef LLC and their affiliated entities, including their immediate family members (spouse, parent, child, sibling, and their respective spouses), are not eligible to participate in the Contest.

2. Contest Period: The Contest begins in the first calendar quarter of 2025 and runs through June 1, 2025 with the winner selected on a monthly basis during calendar year 2025.Winners will be chosen on or before the seventh (7th) day of the calendar month following the date of entry and will be announced on both Rainbowcone.com website within twenty-four (24) hours of selection.

3. How to Enter: To enter, eligible entrants must: (a) have a valid, non-sponsored account on a Designated Social Media Platform; (b) take or obtain a photograph or video of themselves enjoying a The Original Rainbow Cone; (c) post the photograph or video on a Designated Social Media Platform with the hashtag #CenturyOfSMiles; (d) tag in the post @TheOriginalRainbowCone; and (e) tag in the post at least five (5) additional non-sponsored, valid accounts on a Designated Social Media Platform. This will grant the eligible entrant one (1) entry into the Contest. For an entry to be eligible, the posted photograph or video must include both the face of the entrant and The Original Rainbow Cone. Rainbow Cone reserves the right to accept or reject entries that do not comply with the requirements set forth herein or that contain vulgar, offensive, illicit, harmful, inappropriate or disparaging images or other content which, in Rainbow Cone’s sole discretion, are contrary to the spirit and purpose of the Contest. Rainbow Cone also reserves the right to reject entries if the post originates from a sponsored social media account or does not tag at least five (5) additional non-sponsored, valid Designated Social Media Platform accounts.

4. Bonus Entries: Notwithstanding the foregoing, participants can earn up to four (4) additional entries by posting a different photograph or video on the same or different Designated Social Media Platform which includes The Original Rainbow Cone, required hashtags/tags and also tags at least five (5) additional non-sponsored, valid accounts on the same Designated Social Media Platform. The maximum total number of eligible entries any eligible contestant can obtain is five (5).

5. Winner Selection: On or before the seventh (7th) day of each month after the start of the contest period, and through its conclusion, a single winner will be selected by Rainbow Cone from the pool of eligible entries. The winning selection will be the eligible entry that has the most verified likes on the Designated Social Media Platform on which it was posted. Rainbow Cone reserves the right to disqualify entries that obtain likes in any manner that is contrary to the spirit of the contest or in violation of the rules or procedures of the Designated Social Media Platform on which it is posted. In the event that two (2) or more eligible entries have the same number of verifiable likes as of the date of selection, Rainbow Cone will conduct a random drawing to determine the winner.

6. The Original Rainbow Cone: For purposes of the Contest, The Original Rainbow Cone shall mean the traditional Original Rainbow Cone containing all five (5) signature flavors of ice cream on a cone as prepared in a The Original Rainbow Cone store location in Illinois, Indiana or Wisconsin, Any entry which does not include The Original Rainbow Cone will not qualify as an eligible entry. Any entry which also includes in the photograph food or drink items from other restaurant chains or competitors of Rainbow Cone will not qualify as an eligible entry.

7. General Liability Release/Force Majeure: By participating in the Contest, entrants agree to release, indemnify, and hold harmless Rainbow Cone, its parent, affiliates, subsidiaries, and their respective agents, representatives, officers, directors, and employees from any and all liability, loss, damage, claim, or cause of action, including, but not limited to, injury, death, or damages arising out of or in connection with the entrant’s participation in the Contest, or the acceptance, possession, use or misuse of any prize, or any travel related to the Contest or any other promotion-related activity. Rainbow Cone reserves the right, in its sole discretion, to modify, suspend, or terminate the Contest in the event that it becomes impossible to administer due to circumstances beyond its control, including, but not limited to, acts of God, war, terrorism, civil unrest, labor disputes, natural disasters, or any other force majeure event. This also includes situations where the Contest is technically impaired or corrupted, or when fraud, technical problems, failures, or malfunctions, or other causes beyond Rainbow Cone’s control have destroyed, significantly undermined, or impaired the integrity, administration, security, proper play, and/or feasibility of the Contest as contemplated herein. In such cases, Rainbow Cone may, at its discretion, select a winner from eligible entries received prior to the event causing such modification, suspension, or termination.

8. Winner Notification and Acceptance: The winner of each monthly contest will be notified via the email address provided during the registration process within ten (10) days of the selection. The winner must respond to the notification within seven (7) days to claim the prize. If the winner does not respond within the specified time frame, a new winner will be selected based on the next highest number of verifiable likes associated with the eligible entry. Rainbow Cone holds no responsibility for any winner notification that goes missing, is intercepted, or fails to be received by a potential winner for any reason. If a potential winner does not respond within the time frame specified in the prize notification, despite reasonable attempts to contact them, the potential winner will forfeit the prize, and an alternate winner may be chosen. The potential winner may be requested to fill out and return a Declaration of Eligibility, a Release of Liability, and, where legally allowed, a Consent to Publicity (collectively, “Winner Documentation”). If the winner is below the age of majority in their place of residence (a “minor”), Rainbow Cone has the option to either award the prize to the minor’s parent or legal guardian or require the parent or legal guardian to acknowledge and sign the Winner Documentation on behalf of the minor. If any potential winner (or, for a minor, the minor’s parent or legal guardian) does not sign and submit all Winner Documentation within the timeframe specified in the prize notification, the winner may be disqualified, and an alternate winner may be selected.

9. Prize: The winner will receive a year’s worth of Rainbow Cone which consists of a certificate which can be redeemed at any The Original Rainbow Cone location in Illinois, Wisconsin and Indiana for one (1) The Original Rainbow Cone each week for fifty-two (52) consecutive weeks. The certificate will have no cash value and cannot be exchanged for cash. The certificate will expire fifty-two (52) weeks after it has been awarded to the winner and will no longer be of any force or effect. Rainbow Cone reserves the right to reject any attempt by a winner to receive more than one (1) free The Original Rainbow Cone in any week while the certificate is valid and reserves the right to void the certificate in the event that a winner makes repeated attempts to redeem the certificate in violation of the limits set forth herein.

10. Tampering and Disputes: Tampering with the entry process or the operation of the Contest is strictly prohibited and may result in disqualification. Any entries or actions that, in the sole discretion of Rainbow Cone, appear to be fraudulent, generated by a script, macro, bot, or any other automated means, or intended to undermine the legitimate operation of the Contest will be void. In the event of any dispute regarding the identity of an entrant, the authorized account holder of the email address used to register will be deemed the entrant. Rainbow Cone reserves the right to require proof of identity, such as a copy of the entrant’s driver’s license, and shipping information before awarding any prize.

11. Prize Delivery: Once the winner is confirmed and has provided the required information, Rainbow Cone will send the certificate for redemption to the winner’s email account provided during the Contest process. Rainbow Cone is not responsible for any technical delays or difficulties associated with the winner’s receipt of the certificate sent by Rainbow Cone to the email account provided by the winner.

12. Governing Law/Jurisdiction: All issues and questions concerning the construction, validity, interpretation, and enforceability of these Official Rules or the rights and obligations of entrants or Rainbow Cone in connection with the Contest shall be governed by and construed in accordance with the internal laws of the State of Illinois without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of any other state’s laws.

13. Arbitration Provision: By participating in the Contest, entrants agree that any dispute, claim, or controversy arising out of or relating to the Contest, these Official Rules, or the breach, termination, enforcement, interpretation, or validity thereof, including the determination of the scope or applicability of this agreement to arbitrate, shall be determined by arbitration in the State of Illinois, before a single arbitrator. The arbitration shall be administered by the American Arbitration Association (AAA) in accordance with its Commercial Arbitration Rules and the Supplementary Procedures for Consumer-Related Disputes (the “AAA Rules”) then in effect, except as modified by this Arbitration Provision. The AAA Rules are available at www.adr.org or by calling the AAA at 1-800-778-7879. Judgment on the award rendered by the arbitrator may be entered in any court having jurisdiction thereof. This Arbitration Provision shall not preclude parties from seeking provisional remedies in aid of arbitration from a court of appropriate jurisdiction. The arbitrator shall, in the award, allocate all or part of the costs of the arbitration, including the fees of the arbitrator and the reasonable attorneys’ fees of the prevailing party, as the arbitrator deems appropriate. Entrants agree that any arbitration shall be limited to the dispute between the entrant and XYZ Restaurant individually. To the full extent permitted by law, (a) no arbitration shall be joined with any other proceeding; (b) there shall be no right or authority for any dispute to be arbitrated on a class-action basis or to utilize class action procedures; and (c) there shall be no right or authority for any dispute to be brought in a purported representative capacity on behalf of the general public or any other persons.

14. Miscellaneous: By participating in the Contest, entrants agree to be bound by these Official Rules and the decisions of Rainbow Cone, which are final and binding in all matters relating to the Contest. Entrants also agree to abide by all federal, state, and local laws and regulations.
